Medical Malpractice Defense

For a pre-paid monthly flat fee, LUBELL & ROSEN provide complete medical malpractice defense to doctors. We represent both doctors without insurance (known as "Going Bare") and doctors with insurance.

Doctors Without Insurance

Going Bare: Due to the ever increasing cost of medical malpractice insurance, many doctors have made the decision to drop their insurance. There is strong statistical evidence that Going Bare reduces the likelihood of being involved in a lawsuit. However, doctors that Go Bare are responsible for their own legal fees. That's where our program is ideal.

LUBELL & ROSEN's pre-paid legal defense retainer includes all attorney's fees, expert witness fees, court costs, and trial expenses. Please see our rate chart.

Doctors With Insurance

Often, LUBELL & ROSEN is hired directly by an insurance company.  When a doctor has insurance, the insurance company is required to provide legal defense representation on any medical malpractice claim. However, the appointed attorney is an employee of the insurance company, not the doctor. As a result, conflict of interests often arise. This is especially so where the doctor and the insurance company have different opinions on whether or not to settle the case.

LUBELL & ROSEN provide additional coverage to the doctor, free of any conflict. We will attend the doctor's deposition, review pleadings, records, and correspondence, and attend trial during the doctor's testimony. Most importantly, we will protect the doctor's interests against any acts of bad faith from the insurance company.
